Nueces Democrats: We dont know that Joe Benavides will make a better Commissioner than the incumbent


With this precinct I have not a vote however, the County Commissioners are engaged towards progress for our community as a whole.

"Our Large Family attended the "Annual Feast of Sharing" event held at the Bayfront Plaza.

Joe Benavides was one of our servers (i believe he was a soft drink server), and Mrs.Banales also was there with her husband.

I will not talk about the burnt tamale(only I got) but lets just say the mashed potatoes were the best my man says the rolls were the best.

Considering it is election time, I am surprised most politicians were absent. But with the way they rushed you out after you ate, You certainly did not have any time to "network".

The candidates that did attend, I apologize for not mentioning you as I was there only a small window of time..."


It was so different from the last time I went, which with regret, was not last year.

I must say the food was better at the events that cost money."

We dont know that Joe Benavides will make a better Commissioner than the incumbent but I do know Joe was working and he volunteered out of his commitment to the community. Joe has over the years volunteered and donated his services diligently. One might argue he is only volunteering his time and services because he wants to "get elected".

I dont believe this is the case. I have known Joe for a little over two years and I know his father. In the past, Joe Benavides has run a couple of times for office but, he volunteers regardless of whether he is running or not.

Will Joe Benavides continue to volunteer if he wins?

We can only know after we vote for him.

We do know his incumbent opponent was not volunteering at the Feast of Sharing.

We do know Joe Benavides' incumbent opponent was parading around with her hubby in tow. Was she making a statement? The message IMO was she is not worried about her challenger, she does not take him serious and she is not going to change her routine ways for her constituents. We do not know how she represents her constituency but we do know she is not going to change it.

All we can do is allow Joe Benavides to tell us how is going to represent his constituents.

We can ask him questions and hear his answers.

With Joe Benavides' incumbent opponent we dont have to ask her anything because we have her record to refer to.

The only thing I remember is that, "She could work harder" if she gave herself a pay raise.

I also know she was walking around when she should have been working.

As far as the Family name and integrity, we might should ask the ME about the trangressions.

Ask her about the real reason she decided to run.

A very passionate candidate who is anything other than a fake or what some like to call a politician.

Ray is not a Politician and this is a very very positive attribute.

Dont get me wrong he is very well suited for the Senate and the diplomacy is there but there is a sternness that demands his respect kind of like the respect and command he possesses in the classroom. I think we can all agree, if he can handle our youth in the classroom he will do well for us in Washington.

In concurrence with the first responder; it is agreed, the claim is a bit embellishing and heroically ebullient nevertheless Mr Watts opening averment, ("The citizens of the Valley and Gulf Coast have been victimized by poor decisions in corporate boardrooms, favoring greed over safety) cogently defines an element that bullies the average citizenry. An Actuary is a person whose work is to calculate statistically risks, premiums, life expectancies, etc. for the insurance industry and the emerging "bean-counting" approach to risk management in the Corporate Scheme. This "bean-counting" rings clear and is exemplified in the movie "A Class Action" . The central premise of the film is roughly analogous to the controversy surrounding the Ford Pinto and Mustang II.

Durrill v. Ford Motor Company

A rear end collision fire case in which a 1974 Ford Mustang II vehicle exploded into flames. The two occupants of the vehicle, Devary Durrill and Bonnie Watkins, died of burns. The accident happened in Corpus Christi Texas and was tried by Perry & Haas. Watts worked at the Corpus Christi plaintiffs’ firm Perry & Haas, where he trained in vehicle litigation and was involved in numerous suits against Ford.

In the movie "A Class Action" the auto manufacturer utilizes a "bean-counting" approach to risk management, whereby the projections of actuaries for probable deaths and injured car-owners is weighed against the cost of re-tooling and re-manufacturing the car without the defect (exploding gas tanks) with the resulting decision to keep the car as-is to positively benefit short term profitability.

WATT if it was your daughter, wife, son or another whom you hold dear in your heart; WATT amount is worth the life of a human being?

Basically the actuary crunches the numbers and calculates a probability. How many people will die and how many will be injured (if the defect is not corrected) The number of dead and injured are translated into a dollar amount which is weighed
against the cost of re-tooling and re-manufacturing the car without the defect. The decision is made and carried out knowing that their product will kill people. They know their decision will take the life of an X number of unknown and unborn heirs to the HELLHOLE of a death trap to be sold as the dealerships assure the consumer that the product is safe.

The Ford Pinto, one of the best-selling cars of the 1970s, had a defective gas tank with an unfortunate tendency to burst into flames in rear-end collisions. Instead of fixing the Pinto, Ford lobbied against federal regulation affecting fuel tank safety. As part of the lobbying effort, the company prepared a cost-benefit analysis. According to Ford's engineers, it would cost $11* per car, or $137 million per year for the industry as a whole, to meet the rollover standard, while avoiding an estimated 180 deaths per year, along with an equal number of serious burn injuries and a few thousand wrecked cars.

Ford's cost-benefit analysis valued those lives at a mere $200,000 apiece. That number was calculated by the National Highway and Traffic Safety Administration at the request of the auto industry, mainly on the basis of lost wages, plus medical and legal costs and a small amount for pain and suffering. At $200,000 per head, 180 deaths are "worth" $36 million, not nearly enough to "justify" a $137 million expenditure. As Ford saw it, spending an extra $11 per car to fix the gas tank just wasn't worth it.

Despite Ford's lobbying, the gas-tank safety regulation was adopted. Ford responded by immediately, and inexpensively, making the 1977 Pinto safer. But the damage to the company's image had been done. The public realized that Ford had knowingly produced a dangerous car, leading to hundreds, perhaps thousands, of preventable deaths. Ford finally discontinued the model in 1980. --adapted from Priceless


WATT recourse do we have?

WATT will force manufacturers to decide in favor of preserving the life of a human being?

The only way to convince a Corporate Giant is for the cost analysis to favor correcting the defect and the only way to do this is for the cost of a wrongful death to exceed
the cost of re-tooling and re-manufacturing the car without the defect.

Yes, in the eyes of those who have not experienced the ordeal of losing a loved one from a defective products such as Ford Pintos exploding upon impact, Firestone tires falling apart in the Texas heat, Chrysler minivans ejecting belted children due to poor door latches, or due to gross neglect by corporate chieftans, countless bad drugs pulled from the market because of no effective regulatory controls at the FDA and pharmaceutical companies decisions to place profits over patient's lives (Rezulin, Baycol, Fen-Phen, Vioxx), old ladies subjected to unnecessary second surgeries to replace tainted hip implants, 40% is a hefty amount to share with a lawyer. On the other hand WATT choice will stop the recurrence of such preventable accidents? No amount of money can ever compensate for the loss of a loved one or for permanent injury?

Is it worth it for someone to pay you 60% of $500 million so they will hold accountable the ones responsible for deciding to burn your daughter alive?

We at Los Kenedenos concur (although not in totality) with the Author's take on the linked issue.

We do however, express our disappointment in Sheriff Kaelin's partisan political positioning. In hindsight we look back to the previous administration and many an issue we may question, but we do not recall any investigations (while ongoing) conducted in such boisterous fashion. In the same, we do not believe there are any grounds of civil rights violations due to race or ethnicity. It is evident false statements were made in an attempt to spin public opinion and we do find this to be obtuse to the due process afforded to all Americans. We ask Mr Kaelin to remember the faithless party abandonment of his party who now uses him (and his popularity) to launch political strikes. Mr Kaelin needs to realize these shoes he stands in uncomfortably. Everybody is watching, so just be yourself and quit appeasing to Political Powerbase who did not back you up and will run the first time you are in trouble.

Former presidential adviser Karl Rove will headline the annual Bay Area Citizens Against Lawsuit Abuse lunchtime fundraiser today before co-hosting a Republican fundraiser in the evening.

The luncheon event at the Congressman Solomon P. Ortiz International Center is sold out, said Bay Area Citizens Against Lawsuit Abuse executive director Connie Scott.

Rove was an adviser to George W. Bush during his successful run for governor against Ann Richards in 1994. He went on to orchestrate Bush's first presidential campaign and subsequent re-election.

He served as Bush's right-hand man until stepping down in August. Rove has said he wanted to spend more time with his wife, Darby, and his son, who attends college in San Antonio.

Scott said Rove is an interesting and engaging speaker who likely will address his views on lawsuits and trial lawyers, as well as regaling the crowd with tales from the White House and his time with Bush.

Rove was unavailable for comment Tuesday.

Bay Area Citizens Against Lawsuit Abuse, an anti-lawsuit organization, has invited several high profile speakers to the area for its annual fundraisers, including conservative political commentator and best-selling author Ann Coulter, Bush adviser Karen Hughes and Oliver North, a former National Security Council staff member under President Reagan.

Though Rove has stepped out of some of the limelight, he is playing an advisory role in the re-election campaign of U.S. Sen. John Cornyn.

Cornyn also is in town today, making a stop at a health center open house before continuing on to a private fundraiser at meat baron Jerry Kane and his wife Glenda's Hewit Drive home, co-hosted by Rove.

Connie Scott, who also is a Republican candidate for the Texas House of Representatives, and her husband, Mike, who sits on the lawsuit abuse group's board of directors, have known Rove since the 1980s.

I think the Bay Area Citizens against Lawsuit Abuse need to come out of the closet and just admit that they are flaming republicans! They stand four-square for the business community at any expense to individuals. Their choice of speakers may be making them a bunch of money for funding their agenda - but is eye-opening as far as who they endorse! Let's see if they can get Cheney after he leaves office!

Sec. 43.182. DISTRICT ATTORNEY FOR KLEBERG AND KENEDY
COUNTIES. (a) The voters of Kleberg and Kenedy Counties elect a
district attorney. The district attorney has the same powers and
duties as other district attorneys and serves the district courts
of Kleberg and Kenedy Counties.
(b) The district attorney shall attend each term and session
of the district courts of Kleberg and Kenedy Counties and shall
represent the state in criminal cases pending in those courts. The
district attorney has control of any case heard on petition of writ
of habeas corpus before any district or inferior court in the
district.

(c) The commissioners courts of the counties comprising the
district may supplement the state salary of the district attorney.
The amount of the supplement may not exceed $12,000 a year. The
supplemental salary must be paid proportionately by the
commissioners court of each county according to the population of
the county. The supplemental salary may be paid from the officers'
salary fund of a county. If that fund is inadequate, the
commissioners court may transfer the necessary funds from the
general fund of the county.

Sec.i24.207.ii105TH JUDICIAL DISTRICT ([KENEDY, KLEBERG, AND] NUECES COUNTY [COUNTIES]). (a) The 105th Judicial District is composed of [Kenedy, Kleberg, and] Nueces County [counties]. The court shall give preference to criminal cases.

(b)iiThe terms of the 105th District Court begin[:

[(1)iiin Kenedy County on the first Mondays in June and December;

[(2)iiin Kleberg County on the first Mondays in April and October; and

[(3)iiin Nueces County] on the first Mondays in February and August.

(c)iiThe judge, with the approval of the commissioners court, may appoint an official interpreter of the court [in Nueces County] who serves at the will of the judge. The official interpreter shall take both the constitutional oath of office and an oath that he will faithfully interpret all testimony in the district court as official interpreter. The oath is sufficient for his service as official interpreter in all cases in the court [in Nueces County] during the interpreter's term of office. The judge may also assign the official interpreter to assist the court's probation officer in the discharge of the probation officer's duties.

(c)iiThe heading to Section 43.148, Government Code, is amended to read as follows:

Sec.i43.148.iiKENEDY, KLEBERG, AND NUECES COUNTIES [105TH JUDICIAL DISTRICT].

(d)iiSubsections (a) and (c), Section 43.148, Government Code, are amended to read as follows:

CORPUS CHRISTI — Corpus Christi Police Department Capt. Jay Vesely was fired Friday in connection with allegations of wrongdoing at the city’s vehicle impound lot, according to a written statement from Chief Bryan Smith.

Vesely is the second officer fired in connection with allegations of wrongdoing at the impound lot. A third officer, Lt. Weldon L. Weber, was put on paid administrative leave Tuesday and on Friday received a written disciplinary letter.

Senior Officer Martin Jasso, a 22-year veteran with the department, was fired Nov. 2 for abusing his authority as an officer for buying vehicles from the lot, according to a letter Smith sent to the city’s Civil Service Commission and Human Resources Department.

Vesely, who had been with the department for more than 20 years, was the executive officer in patrol responsible for overseeing officers in the downtown and Annaville areas. Weber had been with the department for about 17 years, police officials said.

I am not too happy that Weber got off. He did not deserve to get off. He is not a good officer and should not be in any leadership role. Anybody that is in command that makes up bad things about other cops to get them into trouble should not be on top of subordinates.

Oh well..you can't get your way all of the time, I guess. I am happy with most of the outcome here. It is sad seeing everyone's dirty laundry being spread out on here.

The Chief may be at the bottom of the totem pole here due to all of the negative publicity. However, it seems like he is truley trying to make things right by doing everything the right way here. It is hard letting go of someone you are close to but what is more important?...the officer or how the public views your ability to run a department.

I am still sceptical of him and he is going to have to really prove to me that he can clean this department up. This was a good start.

Post 3 is on the money, for the most part, but something else needs to be looked at - CCPOA involvement in the whole thing!

They started the mess by trying to nail Ken Bung for wanting to use an impound tractor to mow the new firing range (which Ybarra complained about LOUDLY). Made accusations to the Chief(s), who did the right thing and called in outside law enforcement to investigate. Sort of backfired on Ybarra and CCPOA, didn't it?

Ever wonder who's pulling Ybarra's strings these days? Could it be a failed CCPD SGT named Larry Olivarez who's now chasing ambulances for Celis & Company? Possibly Pete Alvarez, who after filling the ranks with compadres and homeys, refused to take responsibility every time something went wrong in the Department?"

Yep! CCPOA is now right up there with LULAC #1, GI Forum and their like - raise a lot of noise, but don't do a damned whing to make the situation better.

One more dirty policeman gone. now they need to bring up charges for illegally confiscating cars and selling them. The FBI needs to supoena the lawyers that knew what was going on and question them. The testimony on some of these wrongdoing has been recorded by the court recorder at the courthouse on the 7th floor.

Some of these dirty policemen need to go to jail. Doesn't make sense to just fire them if they committed a crime. Houston and New Orleans does not need anymore crooked cops.

Saw a news story on Channel 5 that talked about a 20 year old woman getting her muscle car impounded because it desired by a police officer. We should thank CCPD for saving us the gas of driving down to Mexico to experience what it would be like to have our vehicle taken away by a police officer. There are many good cops in out town and then there are some like Asst. Chief Ken Dung who is in charge of the City impound lot that needs to go ASAP! The citizens and the trustworthy cops in C.C. deserve better.

This is really crushing news. What about all of the officers out there that look up to the command. Especially all of the newer guys/gals. They are still wet behind the ears when it comes to the political BS that goes on within the department.

All of this brings bad morale and the sense of no structure. What does all of this teach our newer officers?

Right now the only people I feel sorry for are the hard working officers that risk their lives protecting ours. They are there because they like helping people. I know for a fact that Weber tried ratting out some good officers for something he says they did not do.

That really upsets me to hear that he would do that to his own. I thought highly of him and to hear something like this really dissappointed me.

He is suppose to be a leader. He is suppose to not make judgement over officers he personally likes or dislikes. He should not use his power to make gain for himself. He should work diligently with other divisions of the department instead of trying to throw his weight around and get rid of people so his own people can work in areas he wants them to.

I have heard several officers that have had many years on the department that are wanting to retire early and get out because of all the political BS that is going on. These are good officers that go to work everyday and do their jobs they way they are suppose to. But because they dont play along the good old boy system they get singled out.

All of you good officers out there need to stick and work together in order to make a difference in your department. You all are the future leaders. Is this the kind of department you want when you have put in 10yrs+? Learn to be a team. Without each other you cannot get the job done. After all of this Corpus needs to folow San Antonio and other major cities lead. Any officer (or any city employee) who is cought with a vehicle that has been impounded or sold at the police auction within two years of the date of impoundment is FIRED!!!!! Does not have to own it, just cought with it.. I bet this would take care of any croked officers or city employees. Hire an out of town person to over see the impound yard. Some one with knowledge of impound law and experence in this field. Give him the power to enforce it.. Start an office of profesional standards with an officer and civillan employees that answer only to the City Council, Mayor, and Police Chief. This gives the other employees a place to complain about crooked employees with out having to go and file a police report..

Well, let's see . . . first the Water Department fiasco, then the Building Inspector corruption, and now the Police Department. All this is the results of years of unchecked nepotism, good-ol-boys, and the patron system allowed to occur by lackluster leadership and a befouled Human Resources Department. I worked for the city for more than 15 years, and I can tell you some stories that you would not believe. The paper and TV don't even come close to telling what really happens.

I visited the Sparkling City by the City a few months ago and was appalled, but not really surprised, at the VERY VISIBLE graffiti, litter, high grass, gang-influenced suburb-of-Mexico that the city has become. It looks worse than a cheap and filthy border town.

Too bad. There was always a lot of potential for the city to be more than the dump and ghetto it has become. Your white and hispanic "leaders" are too busy getting a "piece of the pie" for themselves. Don't believe their phony altruism - it's all about greed, political ambition, corruption, paybacks, and feathering their own nests.

After living there and graduating with three college degrees, the best thing I ever did for my family was packing up and moving away.

For those of you that still can, get out before it's too late. For those of you that are stuck there, get some new council members with enough backbone to turn things around.

They just proved that today by not firing him. He broke the law. He got away with it. If any of the officers that he ever did wrong were to complain against him it is very obvious that thier lives would be hell at the department. I was visiting the Rio Grande Valley around the McAllen Metro area last week and I was astonished as to the nice streets, clean neighborhoods, nice shopping centers, and of course their elegant 70 million dollar convention center. That town rocks. I saw new restaraunts that I have only seen in Houston and Dallas already open for business down their. A buddy of mine told me that McAllen has an effective and highly respected city commission and city manager. I think our city leaders could learn something from them and I hope that they turn this town around because it is going to the dumps.

It has not (yet) been established that ANY of the three of them broke the law. Innocent until proven guilty, or did you forget?

What the Chief DID establish were violations of Department Policies of varying degree. In the cases of Jasso and Vesely those violations of policy must have been much more severe or frequent than in the case of Weber.

The Chief has the end results of the investigation, and you don't.

So for you to say that Weber is "an untouchable to the good old boys," shows nothing more than your own ignorance of the situation and your own, "Kill `em all and let God sort `em out," mentality.

The Chief needs to continue the work on cleaning up CCPD….

There is a supervisor in CCPD that gave an improper order to a new Officer that was still on probation. If the rookie obeyed the order, he would be in violation of departmental policy. However, if he disobeyed the request, then he feared that he would suffer punishment or retaliation by the supervisor. In fear of losing his job, the rookie obeyed the order and violated policy.

Later, a citizen made a complaint on this same supervisor. The supervisor knew that there were other Officers that witnessed some of the possible misdeeds. He knew that these witnesses might be asked to give statements about what had occurred. The supervisor misused his position of authority to send a letter to all of the witnesses. In his letter, the supervisor made statements to discredit the citizen that had complained against him. I’m sure that the letter was intimidating to these Officers, since he was their supervisor and was in a position to affect their careers and livelihoods. I looked up “witness tampering”…..wikipedia has a simplified definition.

This supervisor was involved in a domestic disturbance to which Officers were called to his home. The responding Officers noted that the supervisor had been drinking, the Officers on scene observed him driving a car, and the supervisor admitted fighting with his girlfriend over his city owned pistol. The supervisor did not call for his superior to be notified (as policy requires), nor did he request his superior to be called to the scene. The supervisor misused his position of authority to force the Officers on scene to circumvent policy.

In a separate incident, this same supervisor claimed that he had consensual sex with a woman that he knew to be mentally ill. Can the mentally ill give consent? Anyway, at least poor judgement, if not illegal.

The entire Department knows of this guy’s misdeeds, but yet he keeps his job and his position as a supervisor. If he were not a supervisor and in a position of authority, then he would have been fired already. The situation is demoralizing for the Officers and disgraceful to the Department. I think the Chief should ferret out this rogue supervisor and terminate him from the Department before any further damage is done. I intended to list the name of this cancer, but I cannot recall it at the moment. I have every confidence that the Chief knows the identity of this guy.

I don't see how ANYONE can still have confidence in our City Officials or the CCPD.

First there's the multi-million dollar Wi-Fi fiasco, that was unloaded on Earthlink, who unloaded it completely.

Then there was the load of crap in our water and the subsequent Water Department debacle, which the taxpayers were fined $12,000 thanks to Skip Noe.

Oh yeah, then the Building Inspector corruption case which they're trying to sweep under the rug.

And now those who are sworn to protect & serve. . . the CC Police Department, whose Chief has lost credibility with the public & the police, the command staff who protect each other, and their boss, Skip Noe, who says they're doing a good job.

Meanwhile, our murder rate has tripled and area women get raped at twice the national average.

Again, I don't see how people still have ANY confidence in our City Leaders.

I know Marty personally and for many years (many more than 22). He is one of the finest individuals I know.

Chief Smith, you couldn't have chosen a worse time to start firing officers and more over an officer I know personally and with the allegations of impropriety when you have much deeper problems with your officer team.

As for the CID, yeah,.... we know how those investigations are
conducted.

Unconscionability (also known as Unconscientious Dealings) is a term used in contract law to describe a defense against the enforcement of a contract based on the presence of terms unfair to one party. Typically, such a contract is held to be unenforceable because the consideration offered is lacking or is so obviously inadequate that to enforce the contract would be unfair to the party seeking to escape the contract.

In and of itself, inadequate consideration is likely not enough to make a contract unenforceable. However, a court of law will consider evidence that one party to the contract took advantage of its superior bargaining power to insert provisions that make the agreement overwhelmingly favor the interests of that party. Usually for a court to find a contract unconscionable the party claiming unconscionability will have to prove both that there was a problem with the substance of the contract and the process through which that contract was formed. The substantive problem will usually be the consideration, but could also be the terms, interest payments, or other obligations the court finds unfair. Procedural issues that a court could consider include a party's lack of choice, superior bargaining position or knowledge, and other circumstances surrounding the bargaining process.

Upon finding unconscionability a court has a great deal of flexibility on how it remedies the situation. It may refuse to enforce the contract, refuse to enforce the offending clause, or take other measures it deems necessary to have a fair outcome. Damages are usually not awarded.

1) A crime was committed that placed the person in the position of lesser bargaining power.

2) Has the other party (the seller) filed seeking to escape the contract and if so when and under what circumstances.

When a vehicle is impounded in our city lot the retrieval process in itself is unconscionable. Ask somebody who has been there!
